Now that you have been charged with a crime – What do you do next?

Contact a criminal defense attorney - You should not sit down or speak with the prosecutor, the police or a representative of law enforcement without first consulting with a criminal defense attorney. You have certain rights and the possible defenses that can be waived, even if you think you are not waiving your rights.

Remember, the cornerstone of our system is that the State has to PROVE you committed a crime. You are not presumed guilty and you do not have to go into the police to “just clear matters up”.  If you are ever requested to sit down with the police, call and have a criminal defense attorney at your side before you speak with them.

At Julius Law Office we understand that you are afraid and want to “clear matters up”.  However, without having a criminal defense attorney at your side, you may actually make matters worse for yourself.

CALL US AT 952-440-2700.
We have criminal defense attorneys that are loyal to you and will work for you.

What is a crime and what actually happens if I am charged with a crime?
There are many types of crimes that one can be charged with in Minnesota and the United States. Crimes in Minnesota will fall into one of four categories. You may be charged with more than one type of crime and more than one criminal charge – arising out of the same incident.

Petty misdemeanor- is the First Level and is really not a crime-crime
There is no risk of jail, this is a fine only charge. The maximum fine is $300.00.  Petty Misdemeanors are traffic tickets, or speeding tickets and such.

Misdemeanor
A misdemeanor crime will be a crime such as a 5th Degree Domestic Assault, a DUI or DWI (driving under the influence) when one’s BAC is under .20, a disorderly conduct charge, driving without insurance or driving without a license.   The maximum fine is $1000.  One can go to jail with a misdemeanor crime, but not for more than 90 days.   Remember, more than one misdemeanor charge may be made against a person at a time for facts arising from one incident.

Gross Misdemeanor
A gross misdemeanor charge is a more serious misdemeanor charge that may include a charge for a second or more DWI or DUI, or (driving under the influence or driving while intoxicated)  when your Blood Alcohol Concentration ( BAC) is over .20.   Or you have had more than one DWI or DUI conviction in 10 years.   Other crimes that are gross misdemeanors are forgery, come criminal sexual crimes and other theft crime.  The fine can be up to $3,000 and jail time can be up to one year.  You need a criminal defense attorney to speak for you.

Felony
Felonies or Felony crimes are serious crimes.  Jail time will be more than one year.   Some repeat DWI or DUI offenses can be a felony.  Murder is a felony.  Rape and manslaughter are felonies.  Theft, forgery, burglary, and assault are felonies.   Jail time is more than one year and can be life in prison.  We do not have the death penalty in Minnesota.   These are serious crimes and require serious, criminal defense representation by a criminal defense attorney.

At stake are prison time for you and your liberty. You need a serious defense attorney to represent you.  Julius Law Office provides criminal defense for all crimes.
