Q: Why should I attempt to solve my divorce issues with mediation before going to court?

A: Most divorcing couples are required by law to attempt mediation before proceeding to trial. Mediation is helpful because when parties are able to come to a mutual agreement, it is likely to be more effective than when a court-order is imposed upon them, and successful mediation is often less expensive than litigating a divorce.

Q: Do judges do the same thing as a parenting consultant or expeditor?

A: Judges in family court (and elsewhere) shoulder a tremendous amount of cases, and the courts are over-burdened. A parenting consultant or expeditor is often times appointed so that the parenting consultant/expeditor can become thoroughly familiar with your case and make quick and efficient decisions. The benefit to you is a short decision that can usually be made in a few days rather than weeks or months. Because your parenting consultant or expeditor is familiar with your case, they do not require extensive briefs or pleadings, which has the potential of lessening costly delays and loss of time with your child.
