Mediation is a confidential, non-threatening settlement process, where the parties are brought together in a neutral setting. The parties, with the assistance of the mediator, attempt to come to an agreement over their disputed issues. Because the process is confidential, the parties are free to speak their mind without being afraid that their words will be used against them later.
With mediation, an agreement that the parties come to on their own, rather than an order imposed upon them, is more likely to work. It is also likely that the mediation process will be less expensive than litigating a divorce. All divorcing couples are required by law to attend mediation.
